Universal Credit for those with a Disability

KEY FACTS:  

  • Personal Independence Payment (PIP)/Adult Disability Payment (ADP), Disability Living Allowance (DLA)/Child Disability Payment (CDP), Armed Forces Independence Payment (AFIP) and Attendance Allowance (AA)/Pension Age Disability Payment (PADP) are not taken into account as income in calculating Universal Credit.   • A single person on mid or high rate DLA or daily living PIP/ADP will be excluded from the Shared Accommodation Rate if renting in the private rented sector - click here
     
  • If a UC claimant or joint claimant (ie partner) receives Personal Independence Payment/Adult Disability Payment, Disability Living Allowance, Armed Forces Independence Payment, Attendance Allowance or Industrial Injuries Disablement Benefit, or a dependent child/young person receives DLA/CDP or /PIP/ADP, the family is excluded from the Benefit Cap.
     
  • If the claimant or joint claimant (ie partner), dependent child, foster child or non-dependant gets a daily living component of PIP/ADP, mid or high rate care component of DLA/CDP, Armed Forces Independence Payment or Attendance Allowance/PADP and they need and have an overnight carer that stays in a bedroom at their house overnight - then they are allowed an additional bedroom for Bedroom Tax / LHA purposes click here.
       
  • If the claimant and joint claimant (ie partner) are unable to share a bedroom due to disability needs, and the disabled partner is getting a daily living component of PIP/ADP, mid or high rate care component of DLA/CDP or Attendance Allowance/PADP then they can each be allocated a bedroom under the Bedroom Tax / LHA rules - click here.

  • UC claimants with a disabled child getting a daily living component of PIP/ADP, mid or high rate care component of DLA/CDP who cannot share a bedroom can be allocated their own bedroom for Bedroom Tax / LHA purposes. 
     
  • If the claimant or joint claimant (ie partner) are on PIP/ADP daily living, mid or high rate care component of DLA/CDP, Armed Forces Independence Payment or Attendance Allowance/PADP then there should be no no-dependant deduction - or what the DWP call housing costs contributions.

  • If a UC claimant’s non-dependant gets middle or highest rate care DLA, AA/PADP, daily living component of PIP/ADP or AFIP then no housing costs contribution (or non dependant deduction) is deducted from the UC claimant’s Housing Costs Element for them
         
  • Disabled workers can get a Work Capability Assessment (and so may be found to have a Limited Capability for Work or Work and Work Related Activities) if they earn less than the monthly equivalent of 16 x £minim wage a week. If they earn more than that they they have to be on  PIP/ADP, DLA/CDP, AFIP, CAA. to have a Work Capability Assessment - click here.
     
  • Disabled students can remain on UC when they start a full-time course and, for UC purposes, are classed as 'receiving education' (depending on amount of student loans etc) as long as they are on DLA/CDP/PIP/ADP/AA/AFIP and have been found to have a Limited Capability for Work / Work Related Activities - click here.
