Limited Capability for Work: Who has LCW / LCWRA
Who has LCW / LCWRA: Reclaiming UC within 6 months

If, within the past six months, the UC claimant was entitled to UC which included the LCW or LCWRA Element but their previous award terminated because their income was too high, but they become entitled to UC again (within six months), they still meet the conditions to have the LCW or LCWRA Element included in their award. The 'relevant period' is not applicable to them and the LCW(RA) Element can be paid on the first day of entitlement. (Reg 28(3) & (4) UC Regs 2013)

Example:

George had the LCWRA Element included in his UC. He started work and due to the level of his earnings, he had nil entitlement to UC for a couple of months. He struggled to cope with the work due to his health problems and had to give up the job. After 3 months of nil UC, he became entitled again - the LCWRA Element should be included in his UC assessment.
