Housing Benefit can sometimes be paid to prisoners. They may get Housing Benefit if they are remanded into custody, sent to prison or given home detention curfew. It all depends on how long they are likely to be away for and their intentions.
If the claimant is on remand / in prison outside of the GB then they will fall under the 'Going Abroad' rules - click here.
Someone who was not getting Housing Benefit prior to going on remand/into prison can make a new claim for Housing Benefit whilst on remand/in prison as long as they meet all the qualifying criteria.
