Rent Issues: Temporary Absences - Overpayments

If the HB Office asks for an overpayment to be repaid where a claimant is / has been temporarily absent - you will need to check that the HB Office are aware of the claimant's circumstances and awarded benefit correctly and used the right dates.

All too often the HB Office are not aware that the claimant is/has been away from home temporarily or the reason for the absence and therefore are actually entitled to HB.

If they ask for HB to be repaid for a period that includes any time spent on remand this is wrong (assuming the claimant was due to return home within 52 weeks if found not guilty) and should be challenged.

Also ensure that any HB the claimant is entitled to for their notice period has been given if applicable.

And if the overpayment is correct and you are an HA or private landlord, and were unaware of the claimant's circumstances, but the HB Office has invoiced you for the overpayment, then you should request that the HB Office recover the overpayment from the claimant. Standard Letter LOP1.
