Failing to attend a Health and Work Conversation

The Government has introduced an additional, mandatory interview for most new ESA claimants. This interview, called the Health and Work Conversation, should take place at the claimant’s local Jobcentre around four weeks into their new claim, ie. well before their Work Capability Assessment.

If they are not exempt from attending and the claimant fails to attend their appointment without good cause, they could be sanctioned.

Note that, although someone can be sanctioned for not attending a Health and Work Conversation appointment, they cannot be sanctioned for failing to take any actions in the action plan which is agreed at this interview.
