EEA Nationals/'family members' with Pre-Settled Status
Where an EEA National/ 'family member' has been granted Pre-Settled Status under the EU Settlement Scheme then they will be able to claim UC as long as they can show that they: 

  • Have a qualifying 'Right to Reside' for benefit purposes, and
  • Are 'Actually Habitually Resident' in the CTA, and
  • meet all the other UC claiming criteria.
